This website is operated by Plantaholic LLC (“we,” “us,” or “our”). By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including all policies referenced herein.


These Terms apply to all users of the site, including browsers, customers, merchants, and contributors of content.


If you do not agree to all Terms, you may not access the website or use any services.

Shopify Inc. provides the e-commerce platform that allows us to sell our products and services.


Section 1 - Online Store Terms

By agreeing to these Terms, you represent that:

  • You have given consent for minor dependents to use this site

  • Products may be available exclusively online and in limited quantities
  • We reserve the right to limit sales by person, household, or order
  • All product descriptions and prices are subject to change without notice
  • We reserve the right to discontinue any product at any time

Website images are representative only and may not reflect the exact plant or item received.


Section 4 - Our Guarantee

We guarantee that all plants:

  • Are true to name
  • Arrive alive
  • Are in good condition upon arrival

To qualify for replacement:

  • You must contact us within 48 hours of delivery
  • You must provide clear photos showing the issue

Failure to meet these conditions may void the guarantee.


Section 5 - Pest Disclaimer (IMPORTANT)

Due to the nature of live plants, particularly carnivorous plants:

  • We do not guarantee pest-free plants
  • Plants may naturally carry minor pests or microorganisms
  • This is considered normal and not a defect

By purchasing from Plantaholic LLC, you acknowledge:

  • The inherent biological nature of live plants
  • That pest presence does not qualify for refunds or replacements
  • You are responsible for ongoing plant care and pest management


Section 6 - Growing Conditions Disclaimer

Carnivorous plants require specialized care and environmental conditions.

Because we cannot control your growing conditions:

  • We guarantee live arrival only
  • We are not responsible for plant decline after delivery


Section 7 - Shipping Policy

  • Orders ship Monday through Thursday
  • Orders typically ship within 1–14 days after payment clears
  • Shipping is primarily via USPS Priority Mail

Carnivous Plants are shipped:

  • In-soil for Nepenthes
  • Bare-root for all others
  • Wrapped in sphagnum moss or paper towel
  • Packaged for safe transit

Indoor Plants are shipped:

  • In-soil in pot
  • Moistened medium
  • Packaged for safe transit


Weather Disclaimer

  • Extreme temperatures are beyond our control
  • Winter and summer shipments are at buyer’s risk
  • Customers are encouraged to purchase heat packs when necessary
  • We reserve the right to delay shipping due to unsafe weather


Incorrect Address

  • Orders returned due to incorrect addresses void the guarantee
  • Reshipping is at the customer’s expense


Section 8 - Shipping Rates

Shipping charges are based on order total:

  • $0.01 – $99.99: $9.95
  • $100.00+: Free shipping

We reserve the right to adjust shipping charges if actual costs exceed estimates.


Section 9 - Payment Terms

We accept:

  • Credit Cards (Visa, Mastercard, Discover)
  • PayPal
  • Cash, checks, and money orders (where applicable)

Payment must be received before shipment.

Returned checks may incur a $30 fee.


Section 10 - Returns & Refunds

To initiate a return:

  • Contact us within 3 days of delivery
  • Obtain a Return Authorization (RA)

Conditions:

  • Items must be returned in original condition
  • Must be received within 10 business days of RA issuance

Important:

  • Refunds are issued as store credit only
  • Shipping costs are non-refundable
  • Return shipping is the customer’s responsibility
  • A 25% restocking fee applies


Section 11 - Order Cancellations

  • Orders may be canceled before shipment
  • A 25% restocking fee applies if the order has been prepared
  • Orders already shipped cannot be canceled


Section 12 - Substitutions

We reserve the right to substitute unavailable items with:

  • Items of equal or greater value

Customers may request no substitutions at checkout.


Section 13 - Non-Plant Items

We sell plant-related merchandise and supplies.

While we take care in packaging:

  • Non-plant items are not covered under the live arrival guarantee
  • Damaged items must still be reported within 48 hours


Section 14 - Accuracy of Billing Information

We reserve the right to refuse or cancel any order.

You agree to provide:

  • Accurate billing and shipping information
  • Updated contact and payment details


Section 15 - Third-Party Services

Certain services may be provided by third parties (e.g., Shopify, payment processors).

We are not responsible for third-party tools or services.


Section 16 - Limitation of Liabilites

All products and services are provided “as is.”

Plantaholic LLC is not liable for:

  • Improper plant care
  • Environmental damage
  • Shipping delays or carrier issues
  • Indirect or consequential damages


Section 17 - Indemnification

You agree to indemnify and hold harmless Plantaholic LLC from any claims arising from:

  • Your violation of these Terms
  • Misuse of products
  • Violation of laws or third-party rights


Section 18 - Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of North Carolina, United States.


Section 19 – Changes to Terms

We reserve the right to update or modify these Terms at any time.

Continued use of the website constitutes acceptance of those changes.

Return and Refund Policy

At Plantaholic LLC, we strive to provide healthy plants and quality products. Due to the nature of live plants, our return policy is limited and subject to the conditions below.


Live Arrival Guarantee (Plants)

We guarantee that all plants:

  • Arrive alive, and 
  • In good condition upon delivery 

If your plant arrives in poor condition:

  • You must contact us within 48 hours of delivery 
  • You must provide clear photos of the issue 

If approved, we will offer:

  • A replacement, or 
  • Store credit, at our discretion 


Pest Policy

Due to the nature of live plants, including carnivorous species:

  • We do not guarantee pest-free plants 
  • Minor pests or microorganisms are considered normal 
  • Pest-related concerns do not qualify for refunds or replacements 


General Returns (Non-plant Items)

To return non-plant items:

  • Contact us within 3 days of delivery 
  • Obtain a Return Authorization (RA) 

Conditions:

  • Items must be unused and in original condition 
  • Items must be returned within 5 business days of RA approval 


Refunds

  • All refunds are issued as store credit only 
  • Original shipping costs are non-refundable 
  • Customer is responsible for return shipping costs 
  • A 25% restocking fee applies to all approved returns 


Non-Returnable Items

We do not accept returns for:

  • Plants after successful delivery (unless covered under Live Arrival Guarantee) 
  • Items damaged due to improper care 
  • Items returned without authorization 


Order Cancellations
